The following terms and conditions govern the sale by Kingston Technology Company, Inc. ("Kingston") as stated on the invoice
that is provided on all Customer orders for items purchased on Shop.Kingston.com. Products purchased on Shop.Kingston.com are not for
resale and quantity limits may apply. Shop.Kingston.com is unable to process tax exempt orders, including orders for educational, government
or charitable organizations. By accepting delivery of the products described on the invoice, Customer agrees to be bound by and accepts these
terms and conditions. These terms and conditions are subject to change without prior written notice at any time, at Kingston's sole discretion.
Only customers with a valid United States Bank credit card, shipping to an address in the US or its territories, are eligible to purchase from
Shop.Kingston.com. Customers in other parts of the world, please click here.
US Shipments - Orders received by 3PM PST will normally be processed and shipped the same day based on product availability. If your order is received after 3PM on Friday or a holiday, shipment occurs the following Monday or next working day. Kingston is not responsible for shipping or other delays caused by events beyond our control.

- Free shipping applies to orders placed at shop.kingston.com and are delivered to an address in the continental US. Customers in Alaska, Hawaii, and US Territories are given a discounted shipping rate. See tables below for rates and service times.

- Kingston will provide tracking details via a shipping confirmation e-mail.
- Using Fedex: Kingston does NOT ship to freight forwarders, APO, FPO and PO Boxes (in conjunction with FedEx) or addresses outside of the United States or U.S. Territories.
- Using Expedited Mail: Kingston will ship to APO, FPO, PO Boxes and U.S. Territories but does NOT ship to freight forwarders or addresses outside of the United States.
- Kingston is not responsible for shipping or other delays caused by events beyond our control.
- A shipping discrepancy claim must be filed within fifteen (15) days of the order ship date from Kingston.

** Important Note About Delivery Times **
All shipping methods, with the exception of Saturday delivery, will be delivered on a standard business day (Monday - Friday).
Delivery to remote locations may take longer than the delivery method indicates. For example, 2nd day service may take three
to four days to remote locations.
** Important Note About Taxes **
Kingston is required to collect appropriate sales taxes when shipping to the following states: Arizona, California, Colorado, Connecticut, Florida, Georgia, Illinois, Indiana, Kentucky, Massachusetts, Minnesota, North Carolina, New Jersey, New York, Ohio, Texas, Viginia, and Washington. In addition, freight is taxable in Connecticut, Georgia, Kentucky, Minnesota, New Jersey, New York, North Carolina, Ohio, Texas, and Washington. Shop.kingston does not currently have the ability to process tax exempt orders.
As required by law, shop.kingston will collect appropriate taxes in all states where Kingston has a physical presence.

- Your order may be reviewed by Kingston to ensure the order is accurate, the credit card is valid and that you are authorized to use this payment method.
- Orders received by 3pm PST will normally be processed and shipped the same day, based on product availability. Orders received after 3pm PST, on a weekend or holiday will be shipped the next business day (M-F).
- Your credit card is charged once your order ships.

Kingston accepts VISA, MasterCard and American Express and there are no credit card surcharges imposed by Kingston.
Charges will be based on U.S. dollars. International credit cards are not accepted. Orders are not binding upon
Kingston until accepted by Kingston. Acceptance of the order will be evidenced by Kingston's shipment of the

Returns and Refunds
Your satisfaction is 100% guaranteed with any product purchased on Shop.Kingston.com within 30 days of product
purchase. Product replacement or refund is subject to the conditions set forth under the Warranty section of this
Product purchased from shop.kingston.com is not intended for resale. Kingston reserves the right to audit orders
and limit quantities purchased.
Title & Risk of Loss
Kingston retains title and risk of loss until delivery of the Product to Customer's location as evidenced
by signature collected by carrier. The signature collected by the carrier at the Customer address will be
deemed sufficient proof of delivery.
While Kingston uses its best efforts to provide accurate and up-to-date information, we cannot warrant that
the site content is free from any errors or omissions. Upon receipt of your order, if we discover that pricing,
availability or any other product information is inaccurate, we will notify you within 24-business hours of the
error. At that time, you will have the opportunity of electing to proceed with your order based on the correct
data or cancelling. Please feel free to contact Kingston to confirm any information prior to ordering.
In no event shall Kingston's liability for product purchases hereunder exceed the purchase price of the products
Kingston Limited Warranty Statement
KINGSTON TECHNOLOGY COMPANY, INC. ("Kingston") warrants to the original end user customer of its products specified
below that its products are free from defects in material and workmanship. Subject to the conditions and limitations set forth below,
Kingston will, at its option, either repair or replace any part of its products that prove defective by reason of improper workmanship
or materials. Repaired parts or replacement products will be provided by Kingston on an exchange basis, and will be either new or
refurbished to be functionally equivalent to new. If Kingston is unable to repair or replace the product, it will refund the current
value of the product at the time the warranty claim is made.
This limited warranty does not cover any damage to this product that results from improper installation, accident, abuse, misuse, natural
disaster, insufficient or excessive electrical supply, abnormal mechanical or environmental conditions, or any unauthorized disassembly,
repair, or modification. This limited warranty also does not apply to any product on which the original identification information has
been altered, obliterated or removed, has not been handled or packaged correctly, has been sold as second-hand or has been resold contrary
to the US export regulations.
This limited warranty covers only repair, replacement or refund for defective Kingston products, as provided above. Kingston is not liable
for, and does not cover under warranty, any loss of data or any costs associated with determining the source of system problems or removing,
servicing or installing Kingston products. This warranty excludes 3rd party software, connected equipment or stored data. In the event of a
claim, Kingston's sole obligation shall be replacement of the hardware.
Duration of Warranty
The following Kingston products are covered by this warranty for life:
Memory modules including ValueRAM, HyperX and Kingston system specific memory, Flash memory cards (e.g. Secure Digital,
CompactFlash, MultiMediaCard, SmartMedia) ATA Flash, and Linear Flash; memory expansion-boards, networking adapters;
routers, hubs and switches without cooling fans (excluding the power supply), Flash adapters and microprocessor upgrade products.
The following Kingston products are covered by this warranty for a period of five years from the date of original retail purchase: PC Card Readers and USB DataTravelers (excepting the DataTraveler Mini Slim, which is warranted for a period of two years as indicated below).
The following Kingston products are covered by this warranty for a period of three years from the date of original retail purchase: Datapak PC Card Hard Drive products.
The following Kingston products are covered by this warranty for a period of two years from the date of original retail purchase: DataTraveler Mini Slim, Solid state PC Card (PCMCIA) adapters, MobileLite and microSD Reader.
The following Kingston products are covered by this warranty for a period of one year from the date of original retail purchase: DataTraveler Accessory Kit, TravelLite SD/MMC Reader and KPEX Portable Media Player.
Discontinued products not listed in the warranty are no longer covered as their warranty has expired.
This limited warranty applies only to the original end user customer of the product for so long as the original end user
customer owns the product. This limited warranty is non-transferable.
THE FOREGOING IS THE COMPLETE WARRANTY FOR KINGSTON PRODUCTS AND SUPERSEDES ALL OTHER WARRANTIES AND REPRESENTATIONS, WHETHER ORAL OR WRITTEN. EXCEPT AS EXPRESSLY SET FORTH ABOVE, NO OTHER WARRANTIES ARE MADE WITH RESPECT TO KINGSTON PRODUCTS AND KINGSTON EXPRESSLY DISCLAIMS ALL WARRANTIES NOT STATED HEREIN, INCLUDING, TO THE EXTENT PERMITTED BY APPLICABLE LAW, ANY WARRANTY THAT MAY EXIST UNDER NATIONAL, STATE, PROVINCIAL OR LOCAL LAW INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, ARE LIMITED TO THE PERIODS OF TIME SET FORTH ABOVE. SOME STATES OR OTHER JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
KINGSTON PRODUCTS ARE NOT AUTHORIZED FOR USE AS CRITICAL COMPONENTS IN LIFE SUPPORT EQUIPMENT OR FOR APPLICATIONS IN WHICH THE FAILURE OR MALFUNCTION OF THE PRODUCTS WOULD CREATE A SITUATION IN WHICH PERSONAL INJURY OR DEATH IS LIKELY TO OCCUR. KINGSTON SHALL NOT BE LIABLE FOR THE DEATH OF ANY PERSON OR ANY LOSS, INJURY OR DAMAGE TO PERSONS OR PROPERTY BY USE OF PRODUCTS USED IN APPLICATIONS INCLUDING, BUT NOT LIMITED TO, MILITARY OR MILITARY-RELATED EQUIPMENT, TRAFFIC CONTROL EQUIPMENT, DISASTER PREVENTION SYSTEMS AND MEDICAL OR MEDICAL-RELATED EQUIPMENT. IF SUCH USE IS INTENDED, CONTACT KINGSTON FOR COMPONENTS SUITABLE FOR SUCH APPLICATIONS.
KINGSTON'S TOTAL LIABILITY UNDER THIS OR ANY OTHER WARRANTY, EXPRESS OR IMPLIED, IS LIMITED TO REPAIR, REPLACEMENT OR REFUND. REPAIR, REPLACEMENT OR REFUND ARE THE SOLE AND EXCLUSIVE REMEDIES FOR BREACH OF WARRANTY OR ANY OTHER LEGAL THEORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KINGSTON SHALL NOT BE LIABLE TO THE PURCHASER OR END USER CUSTOMER OF A KINGSTON PRODUCT FOR ANY DAMAGES, EXPENSES, LOST DATA, LOST REVENUES, LOST SAVINGS, LOST PROFITS, OR ANY OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING FROM THE PURCHASE, USE OR INABILITY TO USE THE KINGSTON PRODUCT, EVEN IF KINGSTON HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES OR OTHER JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.
THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE OR JURISDICTION TO JURISDICTION.

Kingston is not liable for, and does not cover under warranty, any costs associated with servicing and/or
